Privacy policy
This Privacy Policy applies to the user of any of the media that allow access to information, content, websites, audio or video files or similar (hereinafter, respectively "the User" and "the Content") that the Almine and Bernard Ruiz-Picasso Foundation (hereinafter, "FABA") makes available to the public on the Internet.
FABA's Privacy Policy applies to browsing by the User on any FABA website or mobile application, and from any device that allows access to the Content, such as computers, digital television, tablets, smartphones, social media subscriptions or any other means of internet access.
I. Responsible for the File
The personal data communicated by the User to FABA or collected by FABA after access by the User to the Contents will be included in a file under the responsibility of FABA, with registered address in Madrid, calle Diego de León 59; constituted by deed authorized by the Notary of Madrid, Mr Francisco Javier Cedrón López Guerrero, on 21 June 2002, protocol number 1652; adapted to the current Law 50 /2002 of 26 December 2002, on Foundations by deed authorized by the same Notary, on 22 December 2004, protocol number 2.967; registered in the Register of Cultural Foundations of state competence by Ministerial Order of 28 February 2003 under number 510; registered in the Census of Legal Entities of the Ministry of Economy and Finance with C.I.F. number G-83386508, with e-mail address contacto@fabarte.org and telephone +32 2 627 88 30.
II. Purposes of the processing of the User's personal data
The data provided by the User or collected from the User are used by FABA for various purposes:
a) Define user typologies, segmentations and profiles.
b) To manage, administer, expand and improve the Content, by analysing its use by the User.
c) To design new Content that may be of interest to the User.
d) To manage incidents and the maintenance of FABA's website and applications.
e) Send the User communications, newsletters and information about activities organised by FABA, provided that the User has given his/her express consent to do so.
III. Personal data collected
III.1. FABA will collect data from the User
a) Through the User's browsing and visit to the website www.fabarte.org and access to the Content.
b) Through the forms that the User has voluntarily and expressly filled in and communicated to FABA in order to be informed of its activities or to purchase items in its online shop.
c) The data collected by FABA may be linked to the IP address from which the User accesses the Content or forms. This data will be considered personal data to the extent that it allows the User to be identified or identifiable.
III.2. FABA may associate the following information with the data:
a) Usage and navigation data: For statistical purposes, to monitor usage and improve knowledge of the User's interests, usage and navigation data will be collected on what Content the User visits and when the User visits it.
b) User interests and profile inferred from the consultation of the Content, information on the access device, equipment model, operating system version, unique identifiers of the device or connection, data on the mobile network, failures, system activity, hardware settings, browser type, browser language, date and time of connection request, reference URL, cookies and other data storage and retrieval devices on terminal equipment that allow identification of the User's browser and device; perform analytical studies and display personalised information based on the result of such studies.
c) Information on the territory from which the connection originates in order to verify the availability of viewing rights for certain copyrighted content.
III.3. The personal data that the User has voluntarily and expressly communicated to FABA on online forms or in paper format in order to be informed of its activities or to purchase products will be used for these purposes, as well as, for statistical purposes, to improve our knowledge of the User's interests and preferences.
IV. Data shared with third parties:
IV.1. FABA will not transfer the User's personal data to third parties, unless there is a legal basis that legitimises such processing.
IV.2. FABA uses external providers (such as Google Analytics) that use Cookies to carry out analytical studies of the use of the Contents. Google Analytics is a Google web analytics tool that allows website owners to understand how users interact with their website. More information at:

V. User Rights
The User may exercise the following rights:

VI. Data retention period
VI.1. The User's personal data will be actively processed by FABA until the User exercises the right to erasure.
VI.2. In the event of exercising the right to erasure, the User's data will be blocked and stored in restricted form at the disposal of the competent authorities for a period of 5 years in order to deal with any liabilities arising from the processing.
